A Study of Criminal Justice System Contacts of Former Inpatients

Abstract

There is increasing evidence that persons suffering from major mental disorders are entering the criminal justice system. It was hypothesized that inadequate community care may be a contributing factor. The present investigation followed 112 chronically mentally disabled persons for two years. Half the participants resided in supervised apartments, half on their own. Groups were matched for risk of criminal justice system contact and for risk of readmission to hospital. During the course of the study, four subjects from each group were arrested for minor criminal offenses. The provision of supervision and housing appeared to have no effect on frequency of contact with the criminal justice system. Alternate explanations for this finding are discussed.

Résumé

Il est établi qu'un nombre croissant de personnes souffrant de graves troubles mentaux font leur entrée dans le système de justice criminelle. L'hypothèse a été faite qu'un soutien communautaire inadéquat peut être un des facteurs explicatifs. La présente recherche a consisté à suivre 112 personnes affectées d'un handicap mental chronique. La moitié des sujets habitaient dans des appartments supervisés, l'autre, chez eux. Les groupes ont été appariés quant au risque de contact avec le système de justice criminelle et quant au risque de réadmission à l'hôpital. Pendant la durée de l'étude, quatre sujets de chacun des groupes ont été appréhendes pour des délits criminels mineurs. Les services de supervision et d'habitation semblent n'avoir aucun effet sur la fréquence de contact avec le système de justice criminelle. Des explications alternatives de ces résultats sont alors discutées.
