Youth Justice Reform and the Rights of the Child: A Step Forward or Backward?

Abstract

Our purpose is to examine Canada's new Youth Criminal Justice Act in light of Canada's obligations under the UN Convention on the Rights of the Child and in contrast to the Young Offenders Act. After reviewing the Convention and the Young Offenders Act, we examine the new act to determine its consistency with the Convention. We conclude that the new act is a step forward because of its greater focus on rehabilitation and social reintegration. However, it is an inadequate step because it does not fully ensure the protection, provision, and participation rights of the child as defined by the Convention.

Résumé

Notre objectif est d'analyser la nouvelle Loi sur le système de justice pénale pour les adolescents, en regard des obligations contractées par le Canada aux termes de la Convention relative aux droits de l'enfant des Nations Unies et en comparaison avec l'ancienne Loi sur les jeunes contrevenants. Après une revue de la Convention et de la Loi sur les jeunes contrevenants, nous examinons la nouvelle loi afin de déterminer si elle correspond aux objectifs énoncés dans la Convention. Nos observations nous mènent à conclure que la nouvelle loi constitue un pas dans la bonne direction, en raison de l'importance accrue accordée à la réadaptation et à la réinsertion sociale. Toutefois, nous considérons qu'il s'agit d'un effort insuffisant car la loi ne prévoit pas de garantie solide quant aux droits de l'enfant à la protection, à la prestation de services et à la participation, tels que définis dans la Convention.
